Please read these Terms carefully before using the Services. By accessing or using any part of the Services, you agree to be bound by these Terms, our Privacy Policy, Shipping Policy, Refund, Return, Cancellation, and Exchange Policy, and any other policies or notices posted through the Services. If you do not agree to these Terms, you may not access or use the Services.

MiniWe provides the Services subject to these Terms. We may update, revise, replace, or otherwise modify these Terms from time to time.
Any updated version becomes effective when posted through the Services unless a different effective date is stated. Your continued access to or use of the Services after updated Terms are posted constitutes your acceptance of those changes.
You are responsible for reviewing these Terms periodically. If you do not agree to revised Terms, you must stop using the Services.
2. Electronic Communications
When you visit the Services, create an account, place an order, submit a request, or contact MiniWe by email or another electronic method, you are communicating with us electronically.
You agree that we may communicate with you electronically, including by email, website notice, account notification, order notification, or other electronic means.
You agree that electronic agreements, notices, disclosures, confirmations, records, and other communications satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.
3. Services
MiniWe provides access to custom clay bobbleheads, personalized products, information, content, customization options, resources, tools, and related services through the Services.
Unless expressly stated otherwise, any new features, products, tools, content, or functionality added to the Services are subject to these Terms.
The Services are provided on an “as is” and “as available” basis, subject to applicable law. We do not guarantee that the Services will always be available, uninterrupted, timely, secure, error-free, or free of harmful components.
You are responsible for obtaining and maintaining the devices, software, internet access, and other resources needed to use the Services.
4. Changes to Services
MiniWe may modify, update, add, remove, suspend, restrict, discontinue, or otherwise change all or part of the Services, products, content, pricing, availability, or functionality at any time, subject to applicable law.
We are not liable for changes, suspensions, discontinuations, or unavailability of the Services to the extent permitted by law.
5. Permitted Use
Subject to your compliance with these Terms, MiniWe grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Services for personal, lawful, and non-commercial use.
Without our prior written permission, you may not:

Any unauthorized use of the Services automatically terminates the license granted under these Terms.
6. Accounts and Security
You may be required to create an account to access certain features of the Services.
You are responsible for keeping your account credentials confidential and for activities that occur under your account. You agree to provide accurate, complete, and current information and to update it promptly if it changes.

If you are under the legal age of majority in your jurisdiction, you may use the Services only with the involvement and consent of a parent or legal guardian.
MiniWe may refuse service, suspend or terminate accounts, remove content, limit access, or cancel orders where permitted by applicable law.
7. Orders, Pricing, and Availability
Product descriptions, pricing, promotions, product availability, shipping options, and delivery estimates may change from time to time.
We make reasonable efforts to ensure that product information, prices, and availability are accurate. However, errors, omissions, typographical mistakes, inaccurate descriptions, or pricing errors may occur.
MiniWe reserves the right, to the extent permitted by law, to correct errors, update information, change prices, limit quantities, refuse orders, or cancel orders, including after an order has been submitted. If we cancel an order after payment has been received, we will provide the applicable refund.
Your submission of an order is an offer to purchase the selected products. An order confirmation does not necessarily mean that MiniWe has accepted your order.
We may accept, reject, limit, or cancel an order for lawful reasons, including suspected fraud, inaccurate information, pricing errors, product unavailability, violations of these Terms, or inability to fulfill the order.
For custom-made products, production may begin after we confirm payment, applicable order details, and required customer-provided materials.
8. Custom Products
MiniWe custom products are created using the photos, text, design instructions, preferences, and other materials you submit.
You are responsible for ensuring that all submitted information is accurate, complete, lawful, and does not infringe the intellectual-property, privacy, publicity, or other rights of any person or entity.
You represent and warrant that you have all necessary rights, permissions, and consents to submit any photos, likenesses, personal information, designs, text, trademarks, logos, or other materials provided to MiniWe.
Custom products are handmade and artistic in nature. Minor variations in color, dimensions, facial expression, hairstyle, paint details, pose, clothing, accessories, finish, and overall appearance may occur. Minor variations are not generally considered defects.
The quality and clarity of the photos or other reference materials you submit may affect the final product. MiniWe is not responsible for limitations in likeness, detail, or appearance resulting from low-quality, incomplete, inaccurate, unclear, or insufficient reference materials.
Please review your submitted photos, customization notes, spelling, engraving text, selected options, and shipping address carefully before placing an order.
9. Order Changes
Because MiniWe products are personalized and made to order, changes may be limited once production begins.
You may request an order change within 2 calendar days after your order enters production. After the first 2 days of production, requested changes may require additional payment to cover materials, labor, or remake costs.
We will explain any available options and applicable additional costs before making a requested change. MiniWe is not required to make changes that cannot reasonably be completed or that would materially affect production.

10. Refunds, Returns, Cancellations, and Exchanges
Our Refund, Return, Cancellation, and Exchange Policy is incorporated into these Terms by reference.
Because our products are personalized and made to order, cancellations, returns, exchanges, and refunds may be limited after an order enters production, except where required by applicable law or where MiniWe determines that a product was damaged, materially defective, or substantially different from confirmed order specifications due to an error attributable to MiniWe.

11. Third-Party Services and Links
The Services may include content, offers, links, products, tools, payment methods, shipping services, or other services provided by third parties.
Any transaction, purchase, payment, delivery, promotion, or other interaction between you and a third party is subject to that third party’s terms, policies, and notices.
MiniWe does not control or guarantee third-party websites, services, content, availability, security, privacy practices, or reliability. Your use of third-party services is at your own risk, subject to applicable law.
12. Intellectual Property
All content and materials available through the Services, including the MiniWe name, logos, trademarks, product designs, photographs, images, graphics, text, descriptions, videos, code, interface elements, layouts, and other materials (collectively, “Content”), are owned by or licensed to MiniWe and are protected by applicable intellectual-property laws.
Except as expressly allowed by these Terms or with our prior written authorization, you may not copy, reproduce, republish, upload, post, transmit, display, distribute, modify, translate, create derivative works from, sell, license, or otherwise exploit any Content.
You may print or save limited portions of the Services only for your personal, non-commercial use in connection with shopping or using the Services. You may not remove copyright, trademark, or proprietary notices.
All third-party trademarks appearing through the Services belong to their respective owners. Reference to a third-party trademark does not imply endorsement, sponsorship, affiliation, or approval unless expressly stated.
13. User Content and Feedback
If you submit reviews, photos, messages, comments, suggestions, feedback, questions, ideas, designs, or other materials to MiniWe (“User Content”), you grant MiniWe a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from that User Content for operating, improving, marketing, promoting, and providing the Services, subject to applicable law and our Privacy Policy.
You represent that you have all rights necessary to grant this license and that your User Content does not violate any law or third-party right.
Except where we agree otherwise in writing, User Content, feedback, suggestions, and ideas may be treated as non-confidential. MiniWe has no obligation to compensate you for feedback, concepts, suggestions, or ideas.
14. Shipping and Risk of Loss
MiniWe currently ships only within the United States.
Shipping times and delivery estimates are estimates, not guarantees. Delays may occur because of carrier operations, weather, holidays, address issues, or events outside our reasonable control.
Once your order ships, we will provide tracking information by email. You are responsible for providing an accurate delivery address and monitoring your tracking information.

Nothing in these Terms limits any rights you may have under applicable law.
15. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services and Content are provided on an “as is” and “as available” basis.
MiniWe does not guarantee that the Services will be uninterrupted, secure, timely, error-free, or free of harmful components. We do not guarantee that product information, pricing, descriptions, availability, reviews, or other content will always be accurate, complete, current, or reliable.
Nothing in these Terms excludes or limits any warranty, right, or liability that cannot lawfully be excluded or limited.
16. Limitation of Liability
To the fullest extent permitted by applicable law, MiniWe and its owners, officers, employees, agents, affiliates, suppliers, licensors, service providers, distributors, successors, and assigns will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including loss of profits, revenue, goodwill, data, use, business opportunity, or other intangible losses.
To the fullest extent permitted by law, MiniWe’s total aggregate liability for all claims arising from or related to the Services, products, or these Terms will not exceed the greater of:

The amount you paid to MiniWe for the product or service giving rise to the claim during the 12 months before the event giving rise to the claim; or

17. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless MiniWe and its affiliates, owners, officers, employees, agents, suppliers, licensors, service providers, successors, and assigns from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from or related to:

Any photos, designs, text, materials, or other User Content submitted by you.

18. Non-Waiver and Severability
A failure by MiniWe to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.
If any provision of these Terms is found invalid, illegal, unenforceable, or void, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

Your use of the Services is also governed by the MiniWe Privacy Policy. Please review the Privacy Policy to understand how we collect, use, process, store, and disclose personal information.
20. Prohibited Uses
You may not use the Services or Content for any unlawful purpose or in any way that violates these Terms.

These Terms, together with the Privacy Policy, Shipping Policy, Refund, Return, Cancellation, and Exchange Policy, posted product-specific terms, and other terms expressly incorporated by reference, constitute the entire agreement between you and MiniWe regarding your use of the Services.
These Terms supersede prior or contemporaneous communications, proposals, agreements, representations, or understandings relating to the Services, except for a separate written agreement signed by an authorized MiniWe representative.
22. Governing Law
These Terms and any dispute arising from or related to the Services will be governed by the laws applicable in the state where MiniWe is organized or has its principal place of business, without regard to conflict-of-law principles.
Nothing in these Terms limits rights or remedies that cannot be waived under applicable consumer-protection law.
